(Sound Familiar?) Of course everyone remembers the notorious McDonald’s coffee case - and, the fodder that followed. Is the case against Starbucks just a copycat crime? Just a steamy novella? Clearly, frustration that has reached the boiling point. Reuters reported the case last week and jury is already in with a verdict (not really, just the verdict from the comments page of the article). The comments are scalding. And, it is all one sided. Most have concluded that this woman must be an incompetent loser. C’mon, you ordered HOT tea, isn’t id supposed to be hot?? Gheez! Someone even noted that the next lawsuit will be against Mortons for making their salt too SALTY! Not to say these people are jumping to conclusions . . . but yep, I am saying these people are jumping blindly to conclusions. Ah, but the devil is in the details and supposedly the lawyers all deserve to go to hell, anyway, unless you need one.

Every Case Is About The Facts

So, what are the facts?? To begin with, the Plaintiff is a pro tennis player, Zeynep Inanli. I think that Inanli is likely not the incompetent loser that some concluded she must be. Rather, she was a typical customer that ordered tea at Starbucks, but the lid wasn’t secured by the barista, that’s your coffee house bartender. As Inanli turned to walk with the tea, the lid popped off and scalded her arm. That’s right, scalded it. As a result of the injuries, Inanli was admitted for five (5) days to the Weill Cornell Burn Center in New York City. It turns out that she suffered second degree burns. Second degree burns affect both the outer and underlying layers of skin and are considered to be extremely painful, which can cause a person to go into shock and result in permanent scarring. When you consider the unsecured lid combined with scalding liquid that was hot enough to cause second degree burns to the arm of a pro tennis player, you have a valid cause action. Certainly, the case will be hotly contested. Sure, the Plaintiff will have to overcome the media reaction. But, when all the facts are presented in the proper forum, we’ll see what the jury will decide.
